What is the Domestic Violence Law in California?

You are guilty of domestic violence if you abuse your fiancé or fiancée, your current or former spouse, your roommate, your current of former boyfriend/girlfriend or the parent of your child. Additionally, under 243(3) (1) p.c., you may be charged with the crime of domestic battery.

The following types of actions are considered domestic violence:

  • Threats or harassment, either in person or by phone or email
  • Destruction of personal property
  • Creating a sense of fear that someone will be injured

If police accuse you of inflicting injuries to your intimate partner, you may be charged with a felony. If convicted, you could serve four years in prison. Additionally, if you are convicted of a domestic violence felony and you have two priors, under the California three strikes law, you must serve a mandatory sentence of 25 years in prison.
