What is Voluntary Manslaughter?

Voluntary manslaughter is the killing of another person without premeditation. For example, you walk into your home and find your spouse having an affair with another person, and in the heat of passion, you kill them both. Prosecutors, in this case, would likely seek to have you charged with voluntary manslaughter, because the crime was committed without planning and was instigated by emotional duress.

Additionally, if you are involved in a fight or quarrel with another person and he or she dies, depending on the circumstances of your case, you may be charged with involuntary or voluntary manslaughter. If you are convicted of voluntary manslaughter, you face up to 11 years in prison.

Voluntary Manslaughter As a Defense
