Penalties for Second Degree Murder

- If you have previously served a sentence for murder, you may be sentenced to life imprisonment without the possibility of parole.
- If you commit second-degree murder with a firearm, you face an additional 10, 20, or 25 years in prison.
- If you commit second-degree murder while using a firearm out of a vehicle with the intent to cause serious harm, your sentence may be increased to 20 years to life in prison.
- If your crime is gang related, you will receive a strike on your record and you may receive special sentencing.
- If the victim is a peace officer, your sentence increases to 25 years to life in prison.
